Divorce Frequently Asked Questions

Getting divorced brings up a lot of questions, and you deserve clear answers before you make any decisions. We’ve pulled together the ones we hear most from people across New Jersey, from what a flat-fee divorce actually costs to how long it takes, how mediation works, and what happens with children, support, and property. Browse the sections below to find what you’re looking for, and if your question isn’t covered, reach out and we’ll talk it through with you.

Getting Started

How does flat-fee divorce work?

With a flat-fee divorce, you know the full cost before we start — one set price, no hourly billing, and no surprise invoices in your inbox. You choose the plan that fits your situation, and that’s what you pay through your final judgment. It means you can plan for your divorce the same way you’d plan for anything else in your life. Not sure which plan fits? Start with a free Discovery Call.

What if I don’t qualify for a flat-fee package?

During your Discovery Call, we will outline your options. If you do not qualify for a flat-fee package, we can help you resolve your matter in many other ways without breaking the bank. We offer multiple payment options and access to funding partners, such as Affirm, to help you get started and move your case forward as quickly as possible.

Do you handle anything besides divorce?

Yes. Divorce and mediation are at the heart of what we do, but our team handles family matters across the board — including child custody and child support for unmarried parents, stepparent and second-parent adoptions, prenuptial and postnuptial agreements, post-judgment matters such as enforcing a settlement agreement or modifying an existing support or custody order, and domestic violence matters (which we take in select counties or anywhere when they’re tied to a divorce we’re already handling). If you’re dealing with something that isn’t a straightforward divorce, the Discovery Call is the place to start.

What's the difference between mediation and traditional divorce?

Traditional divorce usually means two lawyers, two sides, and a fight that plays out in court — slow, expensive, and hard to predict. Mediation flips that: you and your spouse work together toward an agreement, with guidance, and skip most of the courtroom drama. You don’t even have to like each other — you just have to be willing to work together. Couples who can do that almost always spend far less time, money, and stress to reach the finish line.

Do my spouse and I need separate attorneys?

Not necessarily. In a non-adversarial divorce, the goal is to reach an agreement together rather than fight on opposite sides, so many couples go through the process without each hiring their own attorney. Some people still choose to have a separate attorney review the final paperwork before signing, and that’s perfectly fine. We’ll walk through what makes sense for your situation during your Discovery Call.

How do I know if we qualify for an uncontested divorce?

An uncontested divorce simply means you and your spouse agree — or are willing to work toward an agreement — on the big pieces: dividing property, support, and any parenting arrangements. And don’t let the word “contested” scare you — it just means you don’t have an agreement yet, not that things are headed for something ugly or drawn out. If you’re not sure where you land, that’s exactly what the Discovery Call is for.

Do I need a reason — or "grounds" — to get divorced in NJ?

No. New Jersey lets you divorce without blaming anyone — the most common path is “irreconcilable differences,” meaning things haven’t worked for at least six months and aren’t likely to. You don’t have to prove fault or air your private life to move forward. For most of our clients, this is the simplest and least stressful route.

What's the Discovery Call and what happens on it?

The Discovery Call is a free, no-pressure conversation to understand your situation and walk you through your options. It’s led by our Client Happiness Coordinator, not an attorney, so it’s about gaining clarity and determining whether we’re the right fit — not legal advice. There’s no obligation, and most people leave the call feeling much calmer about what’s ahead. Book your free Discovery Call.

Will I get to speak with an attorney?

Your Discovery Call is free and led by our Client Happiness Coordinator rather than an attorney — it’s the no-pressure way to understand your situation and options. If you’d like to discuss strategy directly with one of our attorneys before you decide, we can arrange that as well. Most people find the free Discovery Call gives them everything they need to take the next step.

Is everything I share confidential?

Yes. Anything you share with us stays private — that’s the whole point of being able to talk openly about what’s going on. We take your privacy seriously from the very first call. If you mediate with us, what’s said in mediation stays in mediation: it’s privileged, our mediators can’t be called as witnesses, and our notes are never released.

Pricing & Process

How much does divorce in NJ actually cost?

A traditional, contested divorce in New Jersey often costs $15,000 to $30,000 or more per spouse once you add up hourly attorney fees, court time, and any expert fees — and high-conflict cases can exceed that. The hardest part is that you usually don’t know the final number until it’s all over. Our flat-fee plans start at $2,295, so you know the full cost up front, before you commit.

What's included in each Netsquire plan?

Each plan is a full, done-for-you service for one flat fee, with the timeline laid out up front. The Simple Split Plan ($2,295) is for straightforward splits with no kids and no shared property, and it typically wraps up in 6 to 8 weeks. The Smart Settlement Plan ($3,595) is for couples with kids or property who’ve already agreed on the major terms. The Peaceful Mediation Plan ($4,795) adds guided mediation sessions when you need help reaching an agreement, and the Advocate Plan ($5,095) is for when you’re close but need negotiation help — often when one spouse already has an attorney. Every plan includes drafting your full settlement agreement, document revisions, and filing everything with the court to finalize your divorce. Every plan also includes a 30-minute strategy call you can use up to a year after your divorce is final, and the Advocate

Plan even includes a name change at no extra cost. The only cost not included is the court’s $300 filing fee, which every New Jersey divorce pays directly to the court. Most importantly, an experienced attorney guides you the entire way and drafts your documents.

How does your money-back guarantee work?

We back every flat-fee plan with a money-back guarantee. If you decide we’re not the right fit before we’ve drafted any documents or started mediation, you get a full refund, less the 3% card fee, if applicable. That includes after your initial strategy session with your attorney: if you hear the plan and decide not to move forward, you still get a full refund. And if you change your mind after work is underway, we’ll refund you on a prorated basis for the work not yet completed, no questions asked.

Can I make payments in installments?

Yes. Each plan can be split into two payments instead of paying all at once, and we offer financing through Affirm to spread the cost into smaller monthly payments if that’s easier. We’ll walk you through the options during your Discovery Call so you can choose what works for your budget. If Affirm isn’t the right fit, ask about our internal payment plan during the call.

What happens after I hire you?

Once you’re on board, we give you access to our secure client system, where you can upload anything relevant to your case. Then we sit down with you for a strategy session, usually over Zoom, to review everything, answer your questions, and map out exactly how we’ll move you forward. From there, we handle the process and keep you in the loop every step of the way. That strategy session is also protected by our guarantee: if you finish it and decide not to move forward, you get a full refund. Whenever you reach out, you’ll hear back from us within one business day. That’s our written standard for every client.

Common Situations

We have kids. Can we still use mediation?

Absolutely — this is where mediation tends to shine. Working things out together usually means less conflict for your kids to absorb, and the two of you stay in control of decisions about parenting time and support, rather than handing them to a judge. Most parents in this situation use our Peaceful Mediation Plan.

We have a house and retirement accounts. Is mediation right for us?

Yes. Dividing a home, retirement accounts, or other assets is very common, and mediation handles it well when both parties are willing to work toward a fair split. We’ve helped many couples sort through real estate, retirement accounts, businesses, and everything in between without turning it into a courtroom fight. Let’s map this out together on a Discovery Call.

How are alimony and child support decided?

Both come down to your family’s specific numbers — incomes, how long you were married, your parenting schedule, and your kids’ needs — and New Jersey has guidelines that help determine child support. The good news is that it’s usually far more predictable than people fear, and we’ll walk you through how it’s likely to shake out for your situation. It’s one of the first things we map out, so there are no surprises down the road.

My spouse and I aren't really speaking. Can this still work?

It can. You don’t have to be friends — or even in the same room — to mediate. The process is designed to be structured and low-conflict, and a neutral guide keeps the conversation moving even when the two of you aren’t talking much directly.

What if we disagree on something?

Disagreeing on a few things is completely normal — almost every couple does. Mediation is designed for exactly that: working through sticking points one at a time until you reach something you can both live with. You don’t need to agree on everything before you start. You just need to be willing to find common ground.

What if my spouse already hired a lawyer?

That doesn’t automatically mean you’re headed for a court battle. Many cases still settle peacefully, even when one side has a lawyer. Having your own plan keeps you protected and informed. The Discovery Call is a good place to talk through your options so you’re not making decisions in the dark.

I already have a lawyer, and I'm not happy with how it's going. Can I switch to you?

You can. People come to us all the time feeling stuck, overcharged, or left in the dark by their current attorney. Switching is more common and more straightforward than you’d expect. Depending on where things stand, we can step in and take over or simply review what’s happened so far and tell you honestly whether a change makes sense for you. The Discovery Call is a good place to start that conversation.

Timeline & Logistics

How long does the process take?

The majority of our flat-fee divorces wrap up in 6 to 14 weeks, depending on which plan fits and how quickly you and your spouse reach an agreement — far faster than a contested case, which can drag on for a year or more. The more aligned you are going in, the faster it tends to go. While we cannot control how fast the court moves when we submit everything to them, we do everything in our power to get you done as quickly as possible.

Do we both have to live in New Jersey?

At least one of you needs to have lived in New Jersey for a year before filing — that’s the main residency rule, and it still applies even if the two of you now live in different places. If you’re not sure whether you qualify, it’s a quick thing to confirm during your Discovery Call.

Can we do this if we live in different counties?

Yes. Living in different New Jersey counties isn’t a problem, and the entire process can be handled remotely. We work with couples across New Jersey and keep things convenient, no matter where each of you is.

Do we have to go to court?

In uncontested divorces, almost every couple finalizes their divorce without ever setting foot in a courtroom. We’ll tell you exactly what to expect for your case.

Do I have to come into your Princeton office?

Nope. Our office is in Princeton, but we handle everything via Zoom and phone, so you can do this from anywhere. Most clients prefer it that way, especially with work and kids.
